Information & Requirements
THIS AGREMENT is made and entered in to by and between Portable Potty Kings, hereinafter referred to as “suppliers” whose billing and scheduling office is P.O.Box 216, Rincon GA 31326, and the customer, whose information is described in the associated rental contract. The fallowing terms and conditions are in affect and bonding when the costumer signs a contract.
1. Site Requirements/ Restrictions:
1. Hard, flat and level (end to end and side to side) surface for placement of the unit.
2. No overhanging limbs or shrubbery restricting access and installation areas.
3. Ensure there is sufficient area to maneuver unit into place.
4. Ensure that nothing is in the way when we deliver/ pickup the unit (s)
We have attempted to provide information needed for a customer to perform their own review of the installation site and confirm it is acceptable. However, if the renting party feels uncomfortable and would prefer Portable Potty Kings to perform an onsite survey, there will be an additional charge (to be approved before the site survey is preformed).
2. Portable Potty Kings (PPK) Responsibility:
1. Unit will be delivered fully stocked with enough paper products for the duration of a one day rental unless other arrangements are made.
2. Unit (s) will immaculately cleaned and fresh upon arrival.
3. PPK will place unit and set up.
4. PPK personal will instruction on operation of unit (s).
5. Unit will be removed at the scheduled time.
3. Customers Reasonably:
1. A customer representative must be at the site at time of delivery.
2. Customer will be responsible for any and all damages with the unit incurs once it has be set up and deemed operational.
3. Customer will be responsible for having a representative monitor the unit at all times during the event to insure smooth operation of the unit. (Restocking toiletries, picking up trash)
4. Customer is responsible for basic cleaning at the close of the event. All trash should be removed. An $85 cleaning fee will be charged if the unit (s) is left excessively dirty.
5. Customer is responsible for locking unit (s) after event.
4. Attendant:
Portable Potty Kings can provide an attendant for an event. The cost of an attendant will vary depending on the duration and the time of the event. The attendant will continuously monitor the unit (s), replenish the supplies and clean as needed.
5. Delivery, Setup and Removal:
Suppliers will have no responsibility or liability for any delay or failure of delivery that is not the fault of the supplier. Prior to delivery, suppliers and customer will coronate a delivery and removal time that is acceptable to both parties. If the set up or removal is delayed for reason caused by the customer, suppliers will charge an additional $75 per hour for stand by time. In a addition, if pick up or delivery is required by the customer or the location venue on a Saturday, Sunday, or after regular business hours, additional charges will apply and should be coordinated with the suppliers prior to the rental.
6. Rental Rate and Payment:
The pricing on the contract represents the original order by the customer. If the rental exceeds the order dates on the contracts, or if further services were change orders are required by the customer, additional charges will apply. Customer shall pay to supplier the rental amount due according to the invoice (s) associated with rental contract and including any applicable sales tax. Payments shall be paid the suppliers billing office at P.O. Box 216, Rincon GA 31326 or using any major Credit Card. Customer shall provide supplier with a valid credit card number to be kept on file in case of nonpayment of this contract. This credit card will only be used for payment at the customer’s request or if payment is more than 30 days past due from the due date on the invoice (s) associated with the rental contract.
7. Security Deposit:
Customer will make a non interest bearing security deposit of $250 to ensure the full and faithful performance by the customer of all the terms and conditions of the agreement. At the discretion of the suppliers, the security deposit applied against the costs to the suppliers for repairing damages to the unit (s).
8. Late Charges and Returned Checks:
If the complete rental amount is not paid according to the terms of the rental agreement, customers aggress to pay a late charge of $25 or 2% of the outstand balance per month, whichever is greater. The customer agrees to pay $25 charged for any returned check.
9. Sewerage:
The unit holds a limited amount of sewerage and it is the full responsibility of the customer to ensure that over fill does not occur and determine beforehand if more capacity is needed. If waste removal is needed during the event, or in the case of events were regular pump schedules need to be set, prior arrangements must be made with supplier. Supplier will bill waste disposal fees either monthly or at the end of each job, which ever come first.
10. Equipment and Supplies:
If any equipment owned by suppliers is not returned at the rental end, the customer is reasonable for any replacement cost incurred by the supplier, including time to require the item (s).
11. Repairs and Maintenance:
Customer accepts the unit (s) in the present condition, for the uses and purposes described herein. Customer agrees to maintain the unit (s) in good condition and repair, natural and normal wear and tear accepted.
12. Moving the Unit (s):
Customer will not move or alter the unit (s) without prior written consent of the supplier. A $75 fee will be charged if the customer moves the unit without prior written consent of the supplier. If movement is needed after the initial setup, supplier must be notified and if possible will move the unit at addition charge. Customer assumes all responsibility for all damage arising to the unit the movement process. Customer further agrees to pay for the proper repair by suppliers of any damages incurred.
13. Damage to Property:
Customer shall pay all cost for damage to the unit (s) that occurs during customers use or possession of the unit or caused by customer or any customers’ servants, guest, agents, or invitees, wheatear resulting negligence, lack of care, abuse or ordinary use. Once the unit is left at the event, the unit is the full responsibility of the customer. Any damage is the responsibility of the customer, including theft and vandalism.
14. Use and Occupancy:
The Units shall be used for portable restroom purposes only. Customer is not to put the unit to any use which is illegal, creates a nuisance, or causes the rate of insurance on the property to increase. NO SMOKING IS ALLOWED IN UNIT. Customer will use the unit in a careful and proper manner, in accordance with all applicable laws rules and regulations and any manufacturers or suppliers instruction or manuals provide to customer. All local and state law must be fallowed and any disputes including law suits are subject to the laws and regulations as set by local government. Customer agrees to close and lock doors to units at night, fallowing each day or event use.
15. Assignment:
Customer shall not sublet the whole or any part of the unit, nor reassign this agreement or any interest therein, without the prior written consent of the suppliers.
16. Liability and Injury:
Customer expressly agrees to defend, indemnify and hold harmless suppliers from any and all damage to property or injury to person suffered in or with respect to the unit during or by virtue of customers use, possession or operation of the unit whether resulting from negligence, lack of care, abuse or ordinary use. This indemnity shall extend to damage, injury, laws, clam, suits, judgments or actions arising from the negligence of customer or it servants, guest, agents, invitees, or anyone customer controls or employees, or who is near or in the unit, of for damage or injury resulting from the use of the unit (s) or entry or egress into or from such unit. In the event that suppliers are not able to deliver possession customer on the effective date of this agreement for any reason beyond suppliers’ control. Suppliers shall not be responsible for any damages incurred by customer, and suppliers are hereby release from liability.
17. Non-Payment:
Should customer breach this agreement, suppliers may peruse all remedies available at law or in equity, including termination of this agreement without notice, repossession of the equipment without legal process, and recovery of all monies owned. Customer will be responsible for all the cost to recover the payment including attorney fees and expenses, time involved for suppliers and any shipping, copying cost etc.
18. Cancelations:
Suppliers will cancel any reservation and return all money paid by customer, minus a $50 handling fee, if canceled in 30 days or more of the date of the event. If cancelation is 7 to 29 days from the date of the event, supplier will refund 50% of the total cost. NO REFUND is available for cancelations 7 days or less from the date of the event. If an event is rescheduled, an additional $75 rescheduling fee will be added.
19. Entire Agreement:
This agreement represents the full and entire agreement between the parties, and no other term or provision not included herein shall be considered. This agreement may only be amended by a writing signed by all parties hereto.
