An expensive apartment was offered as new but not handed over accordingly. During the inspection, the apartment was still inhabited or furnished and there were no serious signs of wear, damage or defects. Our question regarding damage or defects etc. was answered in the negative and there are also no notes in the purchase offer etc. Only afterwards was a note regarding plaster damage known, which the brokerage office knew about through an email but did not tell us.
The real estate agent should have found out more about the property overall because she was overwhelmed with the technology such as the alarm and intercom system, etc. Despite an explicit request, insufficient or no information was provided regarding the purchase of real estate in Austria or a transfer of residence to Austria. It is significant if you only want to take up my suggestion regarding an information sheet for German customers after all the problems.
With regard to a commission of more than €17,000, it is significant if no or insufficient information is provided or if Mr. Feichtinger refuses to answer certain questions during the handover and laments that he has had so much work to do. This contradicts the statement made by his colleague during the inspection that they were available for all questions, which is to be expected. Any reputable broker should be able to provide information regarding house rules, energy performance certificates and insurance documents correctly and without hesitation. You can't ask a buyer to sign something he doesn't know. In view of the fact that my mother wanted to withdraw from the contract, she sometimes felt under pressure because, among other things, possible damages were announced. As the situation presents itself, claims on the part of my mother must be clarified.
In the meantime, it has turned out that the energy certificate handed over at the time is not correct. On the initiative of a German brokerage office commissioned by my mother, a new, suitable ID card was created and handed over. According to my research, Mr. Feichtinger from Finest Homes is or was working for an "energy team" which prepares energy certificates. Accordingly, as an expert, he should have immediately noticed the identity card that we, as laymen, had questioned before notarization. Submitting a correct energy performance certificate after certification, which is much too late, is not correct. Any legal consequences will be checked if necessary.
Among other things, due to repeated inquiries (verbal and in writing), the specific expiry date regarding the warranty was never communicated.
At the time of handover, the seller and/or the real estate agent informed that the heating was allegedly read off by radio on the day of the handover. It has now turned out that this is not the case.
Due to our complaint, Ms. Rauscher contacted us personally, expressed her regret and offered to take care of our concerns. Unfortunately, so far little or nothing of this is recognizable. The offer to sell the property free of charge for my mother is also obsolete, since a broker has already been commissioned.
My mother is still waiting for certain questions or circumstances to be clarified. According to the notary contract, the sellers have to treat the property with care until it is handed over, which was not the case. Various impurities, signs of wear, etc. are or were present, e.g. due to the moving out, and it was not handed over in mint condition. In view of the high commission and the high purchase price, an incorrect energy certificate, etc., it is unfortunate that one is not prepared to come to an amicable solution.
I am still awaiting an apology from Mr. Feichtinger regarding his outrageous statement that I am a "poor jerk" which can be attested.

Also in view of Ms. Hoyer's assessment, there can be no question that the sale was handled professionally, legally correctly, fairly and competently.
Professional and competent sale of our property. Despite the difficult buyer, the mediation was good, fair and legally correct. We would work with Finest Homes again at any time.
